Email Gift Card Giveaway Official Rules

The ThePeachPlum CRUISE NECESSITIES Email Gift Card Giveaway (the “GiveAway”) is sponsored by ThePeachPlum LLC located at 752 North 2250 West, Suite K, Springville, Utah 84663 with a mailing address of PO Box 307, Payson, UT 84651.  Participation and entry in the Giveaway shall be governed by the terms and conditions below.

ELIGIBILITY: The GiveAway is open only to persons who are 18 years of age or older and legal residents of the United States.  Employees of ThePeachPlum CRUISE NECESSITIES or its affiliates are not eligible to enter or win a prize. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. 

HOW TO ENTER: NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  The GiveAway will run continuously until terminated at the sole discretion of ThePeachPlum CRUISE NECESSITIES with a new gift card GiveAway contest period (“Contest Period”) as determined by ThePeachPlum CRUISE NECESSITIES.  To enter, you must subscribe to the ThePeachPlum CRUISE NECESSITIES deal email list.  Limit One (1) Entry per person, per e-mail address, and per household via Online Entry, regardless of whether a person has more than one address or more than one person uses the same address.

By entering online, you agree to receive emails and/or SMS from ThePeachPlum CRUISE NECESSITIES, which you can opt-out of at any time. Any time, toll, connection and usage rates, if any, charged by your Phone or Internet service provider will be your sole responsibility. Entries generated by script, macro or other automated means are void. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. In the event of any dispute about the identity of a winner based on email address, the winning entry will be declared made by the authorized account holder of the email address at the time of submission of the entry.

ALTERNATIVE MEANS OF ENTRY: You may also enter the GiveAway by mailing a standard-size postcard with your name, date of Contest Period you are entering, and email address to: ThePeachPlum CRUISE NECESSITIES Email Contest, PO Box 307, Payson, UT 84651. Postcard entries must be legibly handwritten, include the date of the Contest Period for which the user is entering, be received at least two business days prior to the Contest Period to be included within the random drawing for that Contest Period, and no more than one postcard/email address may be submitted during the GiveAway per Contest Period.

WINNER SELECTION: Winners will be determined by random drawing to be held at least one business day and up to five business days prior to the applicable Contest Period. Winner will be selected from entries received prior to the current Contest Period (either via subscription to the email list or via the Alternate Means of Entry). The potential winner(s) will be notified via the ThePeachPlum CRUISE NECESSITIES deal email and sent to the email address submitted with the potential winner(s) entry. Winner(s) will have one week to accept the offered prize by emailing info@cruisenecessities.com after which ThePeachPlum CRUISE NECESSITIES may select an alternative winner or none at all.  It is the sole responsibility of the contest winners to check the ThePeachPlum CRUISE NECESSITIES deals email for the winning email address.  ThePeachPlum CRUISE NECESSITIES will have no liability for a winner’s failure to receive a prize notice due to spam, junk email, or other security settings or for the winner providing incorrect or non-functioning contact information.  The drawing will be conducted by ThePeachPlum CRUISE NECESSITIES who will act as the judge of the Contest and whose decisions on all matters relating to the GiveAway shall be final.   

PRIZES/ODDS OF WINNING: One (1) ThePeachPlum CRUISE NECESSITIES Gift Card worth $50 per Contest Period. Approximate Retail Value (ARV) of each Prize: $50.  Overall odds of winning depend on the number of entries received during prior to any given Contest Period. No prize substitution or cash equivalent of prize.  No prize transfer.

CONDITIONS: ThePeachPlum CRUISE NECESSITIES reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the GiveAway (or portion thereof) at any time and for any reason. ThePeachPlum CRUISE NECESSITIES also reserves the right at its sole discretion to disqualify the Entry of any individual. All federal, state and local taxes on prize and any expenses not specified herein are the sole responsibility of the winner. Should a dispute arise regarding the identity of the claimant, ThePeachPlum CRUISE NECESSITIES reserves the sole right to determine the eligible party.  By entering, entrant waives all rights to bring (and covenants not to bring) any claim against ThePeachPlum CRUISE NECESSITIES, its officers, its owners, directors or any other persons or entities associated with this GiveAway. Entrants further agree to release and hold harmless ThePeachPlum CRUISE NECESSITIES from any and all liability arising from their participation in the Contest, or ThePeachPlum CRUISE NECESSITIES’s use of any entry information.  Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of Utah without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of Utah in Utah County.

PUBLICITY AND RELEASE: As a condition of entry into the Contest, except where prohibited by law, each entrant and each winner by accepting a prize grants to The Peach Plum LLC and ThePeachPlum CRUISE NECESSITIES, all right, title and interest in to publicize, broadcast, display and/or otherwise use the GiveAway entrant’s name, city, state, and biographical material (collectively, “Licensed Rights”) in any media for advertising and publicity purposes, without additional review, compensation, or approval of the winner. If Winner does not respond to notification, or is not present when prize delivery is attempted, such prize will be forfeited. By participating, entrants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding in all respects. 

OFFICIAL RULES/WINNERS LIST: For notification of the winners, send a legibly handwritten, self-addressed stamped envelope inside another envelope, addressed to: ThePeachPlum CRUISE NECESSITIES GiveAway Contest Entries, PO Box 307, Payson, UT 84651. The return address on the outside envelope, must match the self-addressed stamped envelope address.  Both outside and inside envelopes must be handwritten.  Requests for winners' lists must be received within one month after the end of the applicable Contest Period.
